On June 15th, the so-called “Goo Ha-ra Act” which prohibits parents from inheriting their children’s property if they do not raise their children or they abuse the children, passed a Cabinet meeting. The Ministry of Justice said that a civil law amendment bill focuses on the “introduction of a system for the loss of inheritance rights.” The amendment was submitted to the National Assembly on June 18th.

 

According to the amendment, the family court can decide whether to deprive the right of an inheritance from an heir at the request of an inheritee if the heir who would inherit the property seriously violates the obligation to support, or commits serious criminal acts. If the inheritance right is lost, the succession by representation, in which spouses or other lineal descendants inherit the property instead, will not be applied, either. 

 

However, the “forgiveness system” was established so that even if there is a reason for the loss of inheritance rights, the person who passes on the property can recognize the right to inheritance if he or she decides to grant forgiveness. The Ministry of Justice expects, “If the civil law amendment passes the National Assembly’s deliberation and is promulgated and enforced, it will prevent unfair treatment such as domestic abuse and more actively reflect the will of those who pass on their property.”

 

Discussions about this law were sparked when the late singer Goo Ha-ra’s mother reportedly demanded an inheritance, even though she had not been in contact for more than 20 years before her death in November 2019.
